Privacy Policy
ABS Sweets B.V. is committed to protecting your personal data. This privacy policy describes in clear words how we deal with personal data. We do everything we can to ensure your privacy and therefore treat personal data with care.
What personal data does ABS Sweets B.V. process?
To be able to perform the contract you enter into with us, we need the following personal data from you. Without the provision of these personal data, it is not possible to conclude an agreement.
Name and address
Your (company) name is stored because we prefer not to address you by your customer number. We need your address and location to send invoices, to contact you or to visit you!
E-mail address
We store your e-mail address so that it is possible to send you messages related to the service or product you purchase from us. We may also use your e-mail address to send newsletters. Of course, you have the option to unsubscribe from these newsletters.
Other data we process
We also collect personal data not intended for the performance of a contract. We do this on the basis of a legitimate interest or on the basis of your consent. This includes, for example, data you have left yourself via the contact form on our website. You can withdraw your consent at any time. This does not affect the lawfulness of the processing of your personal data based on consent from before the withdrawal. It concerns the following data:
Applicants
If you apply for a job with us, we naturally want to know what you have to offer. We delete your submitted data, such as CV, application letter, portfolio or application assignment, within four weeks in case you are not hired. If we wish to contact you at a later date, we will first ask for your permission to store your data longer.
Cookies
We place the following cookies:
- A session cookie, which allows us to track and ensure that completed forms actually arrive;
- A cookie that enables us to see whether your browser supports the use of JavaScript;
- Google Analytics cookie. This does not collect any personal information about you, but allows us to track website usage so that we can improve our website. This cookie is only placed with your consent.
How long do we store your personal data?
We do not store your personal data for longer than necessary for the purposes for which it was collected. For example, we retain financial data under tax law for seven (7) years. We retain contact details of customers, suppliers and other relations for up to two (2) years after the end of the contract/collaboration or two (2) years after the last contact. If you have contacted us (otherwise), we will store correspondence and personal data contained therein until we have followed up and dealt with your message. The message will not be stored for more than one (1) year after settlement (unless it concerns, e.g., a complaint). Data of job applicants will be stored for a maximum of four (4) weeks after the end of the application process, unless you give us permission to store it longer after which we will store your data for a maximum of one (1) year.
What do we process your personal data for?
Of course, we do not process your personal data without reason. We need them for:
- Contacting you in relation to the contract we have entered into, for example sending e-mails;
- Handling responses to our vacancies;
- Gaining insight into the use of our website so that we can improve it where necessary to provide a better experience.
We will not use your personal data for purposes other than those discussed above, unless you have given your prior consent or we are required by law to do so.
Your rights
Pursuant to applicable Dutch and European legislation, as a data subject you have certain rights in relation to personal data processed by or on our behalf. We explain below which rights these are and how you can invoke these rights.
Initially, to prevent misuse, we will send copies and transcripts of your data only to your e-mail address already known to us. In the event that you wish to receive the data at a different e-mail address or, for example, by post, we may ask you to identify yourself. We keep records of completed requests; in the case of a forgetting request, we register anonymized data. You will receive all copies and transcripts of data in the machine-readable data format we use within our systems.
You have the right to complain to the Personal Data Authority at any time if you suspect that we are using your personal data in an inappropriate way.
Right of access
You always have a right to access the data we process (or have processed) that relate to your person or can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days at the latest. If your request is granted, we will send you, at the e-mail address known to us, a copy of all data with an overview of the processors holding this data, indicating the category under which we have stored this data.
Right to rectification and erasure
You always have the right to have the data that we process (or have processed) that relate to your person or can be traced back to you, corrected or deleted. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days at the latest. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data have been rectified.
Right to restriction of processing
You always have a right to restrict the data we process (or have processed) that relate to your person or can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days at the latest. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data will no longer be processed until you lift the restriction.
Right to data portability
You have a right to have the data we process (or have processed), that relates to your person or can be traced back to you, processed by another party. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days at the latest. If your request is granted, we will send you, at the e-mail address known to us, copies or transcripts of all data about you that we have processed or have processed on our behalf by other processors or third parties. In all likelihood, we will no longer be able to continue providing services in such a case, as the secure interconnection of data files can then no longer be guaranteed.
Right to object and other rights
You have a right to object, in appropriate cases, to the processing of your personal data by or on behalf of ABS Sweets B.V. If you object, we will immediately cease processing your data pending the resolution of your objection. If your objection is well-founded, we will make copies of the data we process (or have processed) available to you and then cease processing permanently.
You also have a right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe it does, please contact our contact person for privacy matters.
Transfer and recipients of personal data
We do not transfer your personal data outside the EEA. If we do, for example because a data centre or our supplier is located there, we only do so under the conditions set by privacy legislation by, among other things, making efforts to ensure that an adequate level of protection exists and ensuring the necessary contractual, technical and organisational safeguards.
